These are the terms and conditions that apply to all transactions on XCSHOP.com. The use of this site and any order placements indicates your acceptance of these terms and conditions. If you do not agree to be bound by these terms and conditions, please do not use this site. Please read them carefully.

These terms and conditions do not affect your statutory rights. To order goods through this website you must be at least 18 years of age and able to accept delivery of the order you place.
We will treat each order for goods as an offer by you to purchase the goods subject to these terms and conditions.

All images, descriptive matter and specifications on our web site are for the sole purpose of giving an approximate description of the product. If you require further information on a particular product please contact us through the website.

ACCURACY OF PRODUCT INFORMATION

We cannot guarantee the reliability or the accuracy of the information contained within our pages. All actions taken by the visitor to our website is the responsibility of the individual. PRODUCT REVIEWS

We are not responsible for the content posted in public product reviews, but reserve the right to remove, edit or modify in any way. We also retain the right to use the submitted content with the name it was submitted under in our marketing unless specifically notified in writing by the reviewer.

USER POSTINGS

All reviews which are submitted are checked prior to posting, XCShop.com reserves the right to edit or delete inappropriate reviews. If a review is refused for what ever reason Cross Country International is under no obligation to notify the individual who posted the review. When you submit a review to our website, unless we indicate otherwise, you grant Cross Country International a non-exclusive, royalty-free right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media. You grant Cross Country International the right to use the name that you submit in connection with such content, if you choose to include such information.

PAYMENT AND PRICE

The total price payable for the goods will be stipulated at the time when you place your order whether or not the order has been confirmed. We are entitled to make adjustments to the price to take account of any increase in our suppliers’ prices, changes in currency rates or the imposition of any taxes or duties, or if due to an error or omission the price published for the goods is wrong whether or not the order has been confirmed. We will inform you of the correct price and give you the opportunity to cancel the order.
All prices on our website for orders delivered to the UK include UK VAT where applicable. Orders delivered outside the UK may be liable to additional local sales tax and/or import duties and the customer is liable for these. Prices shown are exclusive of delivery charges which will be payable as indicated at the time of placing your order.

TYPOGRAPHICAL ERRORS

In the event a product is listed at an incorrect price due to typographical error or error in pricing information from our suppliers, taxes or duty changes, we shall have the right to refuse or cancel any orders listed at the incorrect price whether or not the order has been confirmed. If your credit card has already been charged and we subsequently cancel your order, we will immediately issue a credit to your credit card account to the value of the incorrect price (including delivery charges).

PAYMENT METHODS

On the order you must provide us with your exact billing address, telephone number and email address – the postal address must be the same as your credit card bank has on file for you. Please ensure the email address you use is valid as we need this address to confirm the order process to you, most of our correspondence will be via the email address you give so please ensure its correct. (Please read our Privacy Policy on how we use your personal information). Incorrect information will cause a delay in processing your order. Your order will only be processed once authorisation of your credit card has been properly received.

AVAILABILITY OF GOODS

All products and services are subject to availability and may be withdrawn at any time. If we do not supply the goods for any reason we will not charge you for these and we will refund any money already paid for them. However, we will not be responsible for compensating you for any other losses you may suffer if we do not supply the goods.

DELIVERY CHARGES

XCShop.com levies a shipping cost based on the total weight of your order. The rate applied will vary based on the delivery location (UK, Europe, USA, Brazil and Rest of World). You will be given an accurate cost of shipping during the checkout process prior to confirming your order. If your total order weighs more than 20kg you will not be charged shipping at the time of order but we will contact you once we have found the best possible price for post-and-packing. You will be charged extra for postage but can cancel your order if you are not happy to proceed.

DELIVERY TIMES

Our orders are processed and dispatched from the UK using normal postal services. We are unable to give specific delivery dates but, providing the products you have ordered are in stock, we aim to deliver your order within 7 days of receiving the confirmation email that your order has been dispatched if you live in mainland Europe. Orders outside mainland Europe may take longer.
If we or our suppliers are temporarily out of stock, we will notify you of this position and give you the choice of putting your order on hold until new stock arrives, cancelling and being refunded, or choosing other products from XCShop.com of equal value.

DAMAGED, FAULTY, LOST AND INCORRECT GOODS

As soon as we have delivered the goods to your door you will be responsible for them. We will only deliver goods to the address on the order. From the time of delivery of the goods, any loss or damage to the goods shall be at your own risk.
In the event of any transit damage to the goods, shortages or incorrect goods supplied, XCShop.com must be notified within 7 days of you receiving the products. We will ask you to organise the return of the product and provide us with proof of postage. On receipt of that XCShop.com will reimburse you the postage costs in accordance with the UK’s Consumer Protection (Distance Selling) Regulations 2000 (SI 2334)

PRODUCT GUARANTEES

Most of the products supplied are covered by the terms and conditions of the Manufacturer’s Guarantee. This guarantee will most likely exclude faults caused by accident, neglect, and misuse.

OTHER

You will own the goods once we have received your payment in full. Failure by us to enforce any of these terms and conditions will not affect our right to enforce the rest of these terms and conditions.
These terms and conditions are subject to change at any time without prior notice to you.
